Terms of Service

These Terms of Service (hereinafter referred to as "these Terms") set forth the conditions for use of TypingHub (hereinafter referred to as "the Service"). Users (hereinafter referred to as "Users") are asked to agree to these Terms before using the Service.


Article 1 (Application)

  1. These Terms shall apply to all relationships related to the use of the Service between Users and the Service operator (hereinafter referred to as "the Operator").
  2. The Operator may establish various rules and regulations (hereinafter referred to as "Individual Regulations") for the use of the Service in addition to these Terms. These Individual Regulations shall constitute a part of these Terms regardless of their names.
  3. In the event of any conflict between the provisions of these Terms and the Individual Regulations, the provisions of the Individual Regulations shall prevail unless otherwise specified in the Individual Regulations.

Article 2 (User Registration)

  1. Registration for the Service shall be completed when a prospective user agrees to these Terms, applies for registration in the manner prescribed by the Operator, and the Operator approves such application.
  2. The Operator may not approve an application for registration if it determines that the applicant has any of the following circumstances, and shall have no obligation to disclose the reasons:
    • If false information is provided in the application for registration
    • If the application is from a person who has previously violated these Terms
    • If the Operator otherwise determines that registration is inappropriate

Article 3 (Management of User ID and Password)

  1. Users shall properly manage their user ID and password for the Service at their own responsibility.
  2. Users may not, under any circumstances, transfer or lend their user ID and password to third parties, or share them with third parties.
  3. The Operator shall deem any login using a combination of user ID and password that matches the registered information as use by the User who registered that user ID.
  4. The Operator shall not be liable for any damage caused by the use of a user ID and password by a third party, except in cases of willful misconduct or gross negligence on the part of the Operator.

Article 4 (Prohibited Actions)

Users shall not engage in any of the following actions when using the Service:

  1. Actions that violate laws, regulations, or public order and morals
  2. Actions related to criminal activity
  3. Actions that destroy or interfere with the functions of servers or networks of the Operator, other Users, or other third parties
  4. Actions that may interfere with the operation of the Operator's services
  5. Actions to collect or accumulate personal information about other Users
  6. Actions of unauthorized access or attempts thereof
  7. Actions of impersonating other Users
  8. Actions that directly or indirectly provide benefits to antisocial forces in connection with the Service
  9. Actions that infringe on the intellectual property rights, portrait rights, privacy, reputation, or other rights or interests of the Operator, other Users, or other third parties
  10. Actions of posting or transmitting content on the Service that includes or that the Operator determines includes the following expressions:
    • Excessively violent expressions
    • Explicit sexual expressions
    • Expressions that lead to discrimination based on race, nationality, creed, gender, social status, family origin, etc.
    • Expressions that induce or promote suicide, self-harm, or drug abuse
    • Other antisocial content that causes discomfort to others
  11. Actions that have or that the Operator determines have the following purposes:
    • Sales, advertising, solicitation, or other commercial purposes (except those approved by the Operator)
    • Sexual or obscene purposes
    • Meeting or dating unfamiliar persons of the opposite sex
    • Harassment or defamation of other Users
    • Causing disadvantage, damage, or discomfort to the Operator, other Users, or other third parties
    • Using the Service for purposes other than those intended by the Service
  12. Religious activities or solicitation for religious groups
  13. Other actions that the Operator determines to be inappropriate

Article 5 (Suspension of Service Provision)

  1. The Operator may suspend or interrupt all or part of the Service without prior notice to Users if it determines that any of the following circumstances exist:
    • When performing maintenance, inspection, or updates to the computer systems for the Service
    • When providing the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
    • When computers or communication lines are stopped due to accidents
    • When the Operator otherwise determines that providing the Service is difficult
  2. The Operator shall not be liable for any disadvantage or damage incurred by Users or third parties due to the suspension or interruption of the Service.

Article 6 (Copyright)

  1. Users may only use the Service and post or upload text, images, videos, and other information for which they own the necessary intellectual property rights such as copyrights, or for which they have obtained permission from the necessary rights holders.
  2. Copyright of text, images, videos, etc. posted or uploaded by Users using the Service shall be retained by such Users or other existing rights holders. However, the Operator may use such text, images, videos, etc. posted or uploaded using the Service to the extent necessary for improving, enhancing the quality of, or correcting deficiencies in the Service, as well as for promoting and publicizing the Service, and Users shall not exercise moral rights of authorship with respect to such use.
  3. Except as provided in the main text of the preceding paragraph, all copyrights and other intellectual property rights relating to the Service and all information related to the Service belong to the Operator or rights holders who have licensed their use to the Operator, and Users shall not reproduce, transfer, lend, translate, modify, reprint, publicly transmit (including making transmittable), transmit, distribute, publish, or commercially use them without permission.

Article 7 (Usage Restrictions and Registration Cancellation)

  1. The Operator may, without prior notice, delete posted data, restrict all or part of the use of the Service by the User, or cancel the User's registration if the User falls under any of the following:
    • If the User violates any provision of these Terms
    • If it is found that there is a false fact in the registered information
    • If there is no response to contact from the Operator for a certain period
    • If there has been no use of the Service for a certain period since the last use
    • If the Operator otherwise determines that use of the Service is inappropriate
  2. The Operator shall not be liable for any damage incurred by Users due to actions taken by the Operator based on this Article.

Article 8 (Withdrawal)

Users may withdraw from the Service by following the withdrawal procedures prescribed by the Operator.


Article 9 (Disclaimer of Warranty and Limitation of Liability)

  1. The Operator does not expressly or impliedly warrant that the Service is free from defects in fact or law (including defects relating to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, errors, bugs, or infringement of rights).
  2. The Operator shall not be liable for any damage incurred by Users arising from the Service, except in cases of willful misconduct or gross negligence on the part of the Operator. However, this disclaimer shall not apply if the contract between the Operator and the User regarding the Service (including these Terms) constitutes a consumer contract as defined in the Consumer Contract Act.
  3. Even in cases provided for in the proviso of the preceding paragraph, the Operator shall not be liable for any damage arising from special circumstances (including cases where the Operator or the User foresaw or could have foreseen the occurrence of damage) among damages incurred by Users due to the Operator's breach of duty or tort caused by the Operator's negligence (excluding gross negligence).
  4. The Operator shall not be liable for any transactions, communications, or disputes between Users and other Users or third parties regarding the Service.

Article 10 (Changes to Service Content)

The Operator may change, add, or discontinue the content of the Service with prior notice to Users, and Users agree to this.


Article 11 (Changes to Terms of Service)

  1. The Operator may change these Terms without obtaining individual consent from Users in the following cases:
    • When the change to these Terms is in the general interest of Users.
    • When the change to these Terms does not conflict with the purpose of the Service use contract and is reasonable in light of the necessity of the change, the appropriateness of the content after the change, and other circumstances related to the change.
  2. When changing these Terms pursuant to the preceding paragraph, the Operator shall notify Users in advance of the fact that these Terms will be changed, the content of these Terms after the change, and the effective date.

Article 12 (Handling of Personal Information)

The Operator shall handle personal information obtained through the use of the Service appropriately in accordance with the Operator's "Privacy Policy".


Article 13 (Notices or Communications)

Notices or communications between Users and the Operator shall be made by methods prescribed by the Operator. Unless the User notifies the Operator of a change in accordance with the method separately prescribed by the Operator, the Operator shall deem the currently registered contact information to be valid and shall send notices or communications to such contact information, and such notices or communications shall be deemed to have reached the User at the time of transmission.


Article 14 (Prohibition of Assignment of Rights and Obligations)

Users may not assign their position under the use contract or their rights or obligations under these Terms to a third party, or provide them as security, without the prior written consent of the Operator.


Article 15 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.
  2. Any disputes arising in connection with the Service shall be subject to the exclusive agreed jurisdiction of the court having jurisdiction over the location of the Operator's head office.
